GoDaddy – brugsbetingelser for AI

1. Oversigt

Disse brugsbetingelser ("AI-brugsbetingelser") regulerer din brug af alle tjenester, der består af AI-produkter, -funktioner, bots, agenter, tjenester og/eller værktøjer ("AI-tjenester"), der tilbydes af GoDaddy.com, LLC eller dets partnere ("GoDaddy”). Derudover er din brug af AI-tjenester underlagt GoDaddys Aftale om generelle servicebetingelser, Global meddelelse om beskyttelse af personlige oplysninger, Tillæg om databehandling og alle gældende produktspecifikke vilkår eller vilkår, der gælder for den hjemmeside, hvorigennem du bruger vores AI-tjenester (samlet med AI-Brugsbetingelser, "Aftalen"). Begreber, som er anvendt med stort begyndelsesbogstav, men ikke defineret i disse AI-brugsbetingelser, har de betydninger, der er angivet andetsteds i aftalen.

2. Indhold generelt

Du kan give input til AI-tjenesterne ("Input") og modtage eller bruge output fra AI-tjenester, som er baseret på inputtet ("Output"). Input omfatter uden begrænsning al feedback, instruktioner, oplysninger eller prompter, som du giver som en del af AI-tjenester. Input og output er samlet "Indhold". Du er ansvarlig for alt indhold, herunder at sikre, at det ikke overtræder gældende lovgivning eller disse AI-Brugsbetingelser eller andre vilkår i aftalen eller krænker tredjeparts intellektuelle ejendomsrettigheder, offentliggørelse, privatlivets fred eller andre ejendomsrettigheder.
GoDaddy ejer eksklusivt alle rettigheder, titler og interesser i og til AI-tjenesterne og andre tjenester (som defineret i aftalen om Generelle servicebetingelser), og intet i disse AI-brugsbetingelser skal anses for at give dig nogen ejendomsret til AI-tjenesterne.
I forhold til dig og GoDaddy, og i det omfang det er tilladt i henhold til gældende lovgivning, (a) bevarer du dine ejerskabsrettigheder til input og (b) ejer outputtet. I det omfang det er tilladt i henhold til gældende lovgivning, tildeler vi dig hermed alle vores rettigheder, ejendomsret og eventuelle interesser i og til output.
Vi kan bruge indhold til at levere, vedligeholde, udvikle og forbedre vores tjenester, overholde gældende lovgivning, håndhæve vores vilkår og politikker, til at markedsføre og annoncere for vores tjenester og holde vores tjenester sikre. 
Du erklærer og garanterer, at du enten fuldt ud og udelukkende ejer eller har alle nødvendige rettigheder, licenser, samtykker, autorisationer og tilladelser til alt materiale, der bruges som input.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Opsigelse og suspension

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Ansvarsfraskrivelser

DU ANERKENDER OG ACCEPTERER SPECIFIKT, AT OUTPUT FRA AI-TJENESTERNE IKKE ER BLEVET GENNEMGÅET FOR NØJAGTIGHED, PARTISKHED, FORKLARLIGHED ELLER GODKENDELSE AF INTELLEKTUELLE EJENDOMSRETTIGHEDER. GoDaddy FREMSÆTTER INGEN ERKLÆRINGER, TILSIKRINGER ELLER GARANTIER MED HENSYN TIL NØJAGTIGHEDEN, PÅLIDELIGHEDEN ELLER FEJLFRI YDELSE AF AI-TJENESTERNE, HERUNDER (UDEN BEGRÆNSNING), HVORVIDT GENERERET OUTPUT KAN OVERTRÆDE, MISBRUGE ELLER KRÆNKE TREDJEPARTERS INTELLEKTUELLE EJENDOMSRETTIGHEDER.

DU ACCEPTERER OG ACCEPTERER, AT ENHVER BRUG AF OUTPUT FRA VORES AI-TJENESTE ER PÅ EGEN RISIKO, OG DU VIL IKKE STOLE PÅ OUTPUT SOM EN ENESTE KILDE TIL SANDHED ELLER FAKTUELLE OPLYSNINGER ELLER SOM EN ERSTATNING FOR PROFESSIONEL RÅDGIVNING.

DU BØR SØGE UAFHÆNGIG, PROFESSIONEL RÅDGIVNING MED HENSYN TIL PÅLIDELIGHEDEN AF OUTPUT, DER OPRETTES AF AI-TJENESTERNE.

10. Ansvarsbegrænsning

GoDaddy, DENNES FUNKTIONÆRER, DIREKTØRER, MEDARBEJDERE, AGENTER ELLER TREDJEPARTSSERVICEUDBYDERE KAN UNDER INGEN OMSTÆNDIGHEDER HOLDES ANSVARLIGE OVER FOR DIG ELLER ANDRE PERSONER ELLER ENHEDER FOR DIREKTE, INDIREKTE, TILFÆLDIGE, SÆRLIGE, PØNALE SKADER ELLER FØLGESKADER AF NOGEN ART, HERUNDER INDHOLD, DER OPRETTES VED HJÆLP AF AI-TJENESTERNE.

DERUDOVER ANERKENDER OG ACCEPTERER DU SPECIFIKT, AT UNDER INGEN OMSTÆNDIGHEDER VIL GoDaddyS SAMLEDE SAMLEDE ANSVAR I FORBINDELSE MED AI-TJENESTERNE ELLER EVENTUELLE OUTPUTS, DER ER SKABT VED HJÆLP AF AI-TJENESTERNE, OVERSTIGE 10.000,00 USD.

DEN FOREGÅENDE ANSVARSBEGRÆNSNING GÆLDER I DET FULDE OMFANG, DET ER TILLADT I HENHOLD TIL LOVGIVNINGEN, OG VIL FORTSAT GÆLDE EFTER OPHØR ELLER AFBRYDELSE AF NÆRVÆRENDE AFTALE ELLER FOR DIN BRUG AF DENNE HJEMMESIDE, AI-TJENESTERNE ELLER ANDRE TJENESTER PÅ DENNE HJEMMESIDE.

Oversættelser af juridiske aftaler og politikker tilvejebringes udelukkende for nemheds skyld for at gøre det nemmere at læse og forstå de engelske versioner. Målet med at tilvejebringe oversættelser af juridiske aftaler og politikker er ikke at skabe en juridisk bindende aftale, og disse udgør ikke en erstatning for den juridiske gyldighed af de engelske versioner. I tilfælde af eventuelle tvister og konflikter vil de engelske versioner af juridiske aftaler og politikker i ethvert tilfælde være gældende og have forrang i forhold til betingelserne på ethvert andet sprog.
